Please click on the link below and email our staff Contact Us The Twelfth Judicial District Commission on Judicial Performance unanimously recommends that Judge Gordon J. Bosa BE RETAINED. Judge Bosa is a graduate of Ohio University and the Ohio State University School of Law. He has served as the Conejos County Judge since 1980. As a County Judge, Judge Bosa hears criminal cases, civil cases under $15,000, misdemeanors, traffic infractions, small claims, and restraining orders. The Conejos County judgeship is a part-time position. Judge Bosa has also been in private practice for 26 years, concentrating primarily in the areas of education law, personal injury and commercial litigation. The Commission received a written self-evaluation, held four public hearings, and conducted both Courtroom observations and an interview of Judge Bosa. The Commission also reviewed the results of a professional survey of litigants, attorneys, and other professionals who have appeared before Judge Bosa. The results include written comments, an over-all statistical score, as well as statistical scores in five areas: case management, application and knowledge of law, communications, demeanor, and diligence. The results also contain the state-wide average scores for county court and trial court judges. Judge Bosa’s 26 years on the Conejos County bench have given him a depth of experience in working with litigants, knowledge of the procedural and substantive law, and understanding the community which he serves. Judge Bosa takes particular care to insure that those who appear before him fully understand their rights and the court process. Judge Bosa is noted for his integrity and firmness on the bench. Judge Bosa received the grade equivalent of “B” from attorneys responding to the survey both over-all and in each of the five survey categories. He received his highest scores from attorneys for maintaining appropriate control over the courtroom, making decisions without regard to possible criticism, and making decisions without fear of being appealed. Judge Bosa received his other high scores for treating unrepresented parties fairly, and being able to identify and analyze relevant facts. 76% of the attorneys responding to the survey recommended that Judge Bosa be retained. Judge Bosa also received the grade equivalent of “B” over-all and in each of the five categories from non-attorneys responding to the survey. Non-attorneys scored Judge Bosa highest for his communication skills. For example, using language that everyone can understand and making sure participants understand the proceedings and what is going on in the courtroom. Other high marks of note from non-attorneys included giving the courtroom proceedings a sense of dignity, giving each side enough time to present their case, and being prepared for Court. 81% of the non-attorneys responding to the survey recommended that Judge Bosa be retained.

The Commission reviewed written evaluations of Judge Bosa completed by individuals appearing in his courtroom, reviewed Judge Bosa’s written self-evaluation, held a public hearing in Conejos County and conducted a personal interview with Judge Bosa. Judge Bosa was appointed to the Conejos County Court bench in September of 1980. Before taking the bench Judge Bosa served as Deputy District Attorney for the Twelfth Judicial District. Judge Bosa practices in Alamosa in addition to fulfilling his part-time position as county judge. Judge Bosa received his undergraduate degree from Ohio University and his law degree from Ohio State University. Approximately 60% of Judge Bosa’s caseload is devoted to criminal traffic offenses and infractions, and the remainder devoted equally among civil and other misdemeanor and felony cases. Judge Bosa received consistent marks from both attorneys and non-attorneys. He received higher marks than the state average for county court judges in the areas of emergency access to the courts and effective management of court time and dockets. Attorneys gave Judge Bosa high marks for being prepared on all court matters. Of the attorneys responding to the survey, 85% recommend retention and 15% recommended non-retention. Sixty-five percent of the non-attorneys recommended retention, 19% recommended non-retention and 17% had no opinion. Judge Bosa is very much aware of issues surrounding rulings issued by the court, including their ramifications on the individual, his or her family and the surrounding community. The Commission was impressed with Judge Bosa’s efforts, when issuing sentences, to balance the traditional functions of sentencing and the need for consistent penalties with the needs of the best interests of the individual, his or her family and the community. Judge Bosa takes a very pragmatic approach to his duties that well serves a predominantly rural area. Individuals sentenced by Judge Bosa have the highest rate of compliance with court-ordered programs, such as alcohol and domestic violence. Judge Bosa substitutes for county judges throughout the Twelfth Judicial District as needed, and acts as district judge when requested by the chief judge.

  Retention Year: 1998 Recommendation: Retain The Twelfth Judicial District Commission on Judicial Performance unanimously recommends that Judge Gordon J. Bosa BE RETAINED. Judge Bosa, who resides in Sanford, Colorado, was appointed as Conejos County Judge in September 1980. He graduated from Ohio University in 1975 with a major in communications. He graduated from Ohio State University Law School in 1978 and was admitted to the Colorado Bar in September 1978. As a county judge, he handles traffic, misdemeanor, criminal, civil cases under $10,000, small claims and temporary restraining orders. Judge Bosa strongly believes in the Canons of Judicial Conduct and feels that if the Canons cannot be followed, a judge is not being true to the people and the country he represents. He feels that it is very important to know the people who reside in the county and to know their circumstances. Judge Bosa notes that some of his best qualities are his patience on the bench and knowledge of the law. In court, Judge Bosa tries to accommodate both sides fairly and will explain to the losing party the reason for his decision. He will give ample time to parties to pay fines, but expects that they follow the established timetable. The great majority of all groups surveyed (court personnel, law enforcement, jurors, and attorneys) returned favorable questionnaires. As to survey comments questioning his judicial temperament and courtesy, Judge Bosa acknowledges that he intentionally expresses anger toward parties who have not complied with the court's directives.

  Retention Year: 1994 Recommendation: Retain Judge Bosa has been the Conejos County Judge since 1980. He also maintains a part-time private civil practice. Judge Bosa’s law degree was awarded from Ohio State University in 1978, and he served as Deputy District Attorney in the District prior to his appointment to the bench. Judge Bosa received generally high ratings from the sampling of written surveys, particularly from law enforcement and attorneys. Although he didn’t fill out a written self-evaluation, his responses at the time of interview were candid and helpful in all areas addressed by the Commission. Judge Bosa appears to be knowledgeable and displays an overall sense of justice in his management of the courtroom an decision making. The most significant area of public criticism relates to his judicial demeanor, which at times is experienced as lacking in emotional temperance, patience and courtesy. Judge Bosa acknowledges a tendency to become harsh in the face of repeat non-compliance by defendants, but feels that the community needs to know what behaviors are unacceptable. In terms of docket management, he noted that he is working on improving punctuality of proceedings, related both to his own schedule and that of the criminal bar. He also needs a better system of anticipating judicial conflict of interest in civil matters. He seems open to suggestions for improvement. The 12th Judicial District Commission on Judicial Performance unanimously recommends that Judge Gordon Bosa BE RETAINED.

  Retention Year: 1990 Recommendation: Retain Judicial Performance Commission’s recommendation: Should Be Retained. Judge Bosa graduated from Ohio University in 1975 with a major in communications. He graduated from law school at Ohio State University in June 1978 and was admitted to the Colorado Bar in September 1978. He was a deputy district attorney with the 12th Judicial District Attorney’s Office for about two years before being appointed as judge of Conejos County in September 1980. He handles traffic, misdemeanor and criminal cases; civil cases under $5,000; small claims court; and temporary restraining orders. Bosa says he feels it is important to have a county judge in each county who knows the people and the circumstances of the people in the county; that his best qualities are patience on the bench and knowledge of the law; and it is important to have standard sentencing practices so all people are treated equally. He regularly attends seminars and reads magazines to keep up with the changes in the law. In small claims proceedings, Bosa says it is important to listen to both sides and then to the extent possible try to accommodate both sides. Bosa says defendants in criminal and traffic cases should be given sufficient time to pay their fines but that it should be done promptly, and he monitors the payment of such fines regularly. The great majority of all groups surveyed returned favorable questionnaires, but several respondents expressed concern about the judge’s control of his temper in the courtroom.

The 2006 survey was conducted by Talmey-Drake Research & Strategy, Inc., who attempted to contact over 75,000 people who had been in these courtrooms in one capacity or another. Over 21,000 people responded—4,600 to the attorney survey and 17,000 to the non-attorney survey. This report contains the results of those who were in your courtroom and who responded to the survey. These names and addresses where then supplemented from the Colorado District Attorney’s database (Blackstone system) and the databases of jurors, court employees and sheriff’s security. The data was then combined and cleaned. Where there were more than 400 potential respondents, a random sample was drawn. Included in the data cleaning was the identification of potential respondents in the sample who had appeared in more than two judges’ courtrooms. Due to concerns about respondent fatigue, no more than two questionnaires were intended to be sent to any one respondent—though there were a few instances where one respondent did receive more than two questionnaires. Where a person had been in more than two judges’ courtrooms, the selection criteria for which judges he or she would be sent questionnaires was generally: first, for the judge in whose courtroom the potential respondent had been in most often, and two, the judge with the smallest sample of the judges in whose courtroom the potential respondent had been in. Survey: Starting in October 2005, each person in the sample database was mailed an initial questionnaire and an introductory letter with a postage-paid return envelope. Those who did not respond to the first questionnaire were then sent a sent a second questionnaire and letter, and in some cases reminder postcards. During this process, the sample was augmented for judges with a particularly low number of completed questionnaires. Questionnaire: The questionnaire used in the 2006 Judicial Performance Survey asked respondents to use a grade of A, B, C, D, or F (Fail) to assess the judge’s performance in five different areas. For attorney these areas were Case Management, Application and Knowledge of Law, Communications, Demeanor and Diligence, and for non-attorney respondents the five were Demeanor, Fairness, Communications, Diligence and Application of Law. These scores were then converted to a numerical value where A = 4, B = 3, C = 2, D = 1 and Fail = 0. Copies of the questionnaires are included at the end of this report. Response: The response rate is calculated as the number of completed questionnaires divided by the number of eligible respondents who actually received a questionnaire. The following table shows the total number of questionnaires mailed, completed, non-responses & refusals, undeliverables and other responses. Graphs: The graphs visually display the overall average numerical grades received for all grade questions, each section and each question compared to averages for all district or county judges, and all trial judges for which 2006 surveys were conducted. An average grade point for each graded question is computed and shown in the results section. A letter grade is also assigned to each grade point according to the following scale. Sampling All sample surveys are subject to what is known as sampling error—the Error: extent to which the results of the sample survey may differ from what would be obtained if the entire population being surveyed had been interviewed. The size of the sampling error is almost entirely due to the number of people interviewed for the survey and the variance of responses. The table below shows the extent of sampling error (95%-confidence interval) for various sizes of random samples and sample percentage results. Box 128 Main St. Conejos, CO 81129 Dear Judge Bosa: Every two years the Colorado Judicial Performance Commission conducts a survey of people who have been in the courtroom of judges who face a retention vote in the next general election. The 2002 survey was conducted by Talmey-Drake Research & Strategy, Inc., who attempted to contact over 55,000 people who had been in these courtrooms in one capacity or another. Over 18,000 people responded—3,686 to the attorney survey and 14,925 to the non-attorney survey. This report contains the results of those who were in your courtroom and who responded to the survey. In addition to this introduction, the report is divided into four main sections: • Results: This section contains the average and percentage distribution of responses to each substantive numerical question in the survey. It is divided into two subsections, one for the results of the attorney survey and one for the results of the non-attorney survey. • Comments: Respondents were also asked to comment about each judge on each section of the questionnaire: courtesy, impartiality, communications skills, judicial temperament, diligence, application of the law, retention and general comments. These comments have been transcribed, and in some instances redacted to eliminate respondent identifying information. From this list of cases, Talmey-Drake Research drew a sample of the 250 cases most recently closed for each judge or justice. In some instances where there were an insufficient number of cases (or participants in cases), the time period during which cases could be drawn was lengthened. For each case selected a list of people associated with the case who had likely appeared in the judge’s courtroom were drawn from the Judicial Department’s database, ICON, and the Colorado District Attorney’s database (Blackstone system). The cases and the associated case participants were divided up among the 22 judicial districts and put on CD ROM. These CD’s were distributed to the judicial districts, and district personnel added the names of people who were associated with a case, but whose names and addresses had not been captured electronically. The data from the judicial districts were then returned to Talmey-Drake Research where the data was combined and cleaned. Included in the data cleaning was the identification of potential respondents in the sample who had appeared in more than two judges’ courtrooms. Due to concerns about respondent fatigue, no more than two questionnaires were intended to be sent to any one respondent—though there were a few instances where one respondent did receive more than two questionnaires. Where a person had been in more than two judges’ courtrooms, the selection criteria for which judges he or she would be sent questionnaires was: first, for the judge in whose courtroom the potential respondent had been in most often, and two, the judge with the smallest sample of the judges in whose courtroom the potential respondent had been in. Added to this database were a database of jurors and one of court employees. Survey: In November 2002, each person in the database was mailed a postcard saying they would receive a questionnaire concerning judicial performance and that it was important for them to fill it out and return it. Shortly thereafter, they were sent an initial questionnaire and an introductory letter with a postage- paid return envelope. Those who did not respond to the first questionnaire were then sent a sent a second questionnaire and letter. Non-respondents to the second survey were sent a reminder postcard. At this point, non- responders who had been sent questionnaires about judges who had not yet achieved a target cooperation rate of 40% were sent a third letter and questionnaire—and a follow up postcard. During this process, the sample was augmented for judges with a particularly low number of completed questionnaires. 1 ## Page 51 Questionnaire:The questionnaire used in the 2002 Judicial Performance Survey is identical to the questionnaire used for the 2000 survey. Respondents were asked to use a grade of A, B, C, D, or F (Fail) to assess the justice’s or judge’s performance in the areas of Courtesy, Impartiality, Communication, Judicial Temperament, Diligence and Application of the Law. These scores were then converted to a numerical value where A = 4, B = 3, C = 2, D = 1 and Fail = 0. Response: The response rate is calculated as the number of completed questionnaires divided by the number of eligible respondents who actually received a questionnaire. The following table shows the total number of questionnaires mailed, completed, non-responses & refusals, undeliverables and other responses. The table presents the overall response rate as well as the response rate by the different types of respondents. This section contains these comments—again divided between results from attorneys and non-attorneys. Sampling All sample surveys are subject to what is known as sampling error—the Error: extent to which the results of the sample survey may differ from what would be obtained if the entire population being surveyed had been interviewed. The size of the sampling error is almost entirely due to the number of people interviewed for the survey and the variance of responses. Averages such as grade points also have a 95% confidence interval, however it is not so easily displayed in a table as confidence intervals about a percentage.
