Please click on the link below and email our staff Contact Us The State Commission on Judicial Performance recommends by a vote of 10 to 0 that Chief Judge Janice B. Davidson BE RETAINED. Background: Chief Judge Davidson was appointed to the Colorado Court of Appeals in 1988. She was a Denver County Court Judge for 3 years before that and previously served as an assistant attorney general, public defender, and as an attorney for the Equal Employment Opportunity Commission. She graduated from Skidmore College and from the University of Pennsylvania School of Law. As chief judge since 2003, her administrative duties include court policies, budget issues, facilities, division assignments, judge workloads, and staff supervision. Her community interests include the American Red Cross and the YMCA (Central Branch). Strengths: Attorneys who responded to survey questions rated Chief Judge Davidson at the survey average of other Court of Appeals judges for: (1) being fair and impartial toward both sides of a case, (2) writing opinions that are clear, (3) making decisions without regard to possible criticism, and (4) refraining from issues that need not be decided. She was also rated at the survey average for: (1) making reasoned decisions upon the law and facts, (2) being courteous toward attorneys, and (3) refraining from reaching issues that need not be decided. Attorneys' comments indicate that Chief Judge Davidson is extremely hardworking and good at balancing court administration duties and deciding cases. While attorneys rated Chief Judge Davidson slightly below the survey average for writing opinions that adequately explain the basis of the decision, the Commission does not give this much weight. The survey data does not indicate that the Chief Judge is responsible for writing most of the court’s summary decisions, which do not require extensive explanation. The Commission reviewed various opinions that Chief Judge Davidson wrote and found that they are generally well-reasoned and well-written. Weaknesses: Attorneys rated Chief Judge Davidson slightly below the survey average of the other judges for: (1) issuing opinions in a timely manner, (2) allowing parties to present their arguments and answer questions, and (3) being prepared for oral argument. Recommendation: 84% of attorneys surveyed and 93% of judges surveyed strongly recommended that Chief Judge Davidson be retained in office. Overall, 93% of attorneys and 99% of judges supported her retention. The Commission unanimously recommends that Chief Judge Davidson be retained.

    Retention Year: 1998 Recommendation: Retain The State Commission on Judicial Performance recommends that Judge Janice B. Davidson BE RETAINED. Judge Davidson was appointed to the Court of Appeals in 1988. She was a Judge on the Denver County Court, 1985-1988, and an Assistant Attorney General in both the Litigation Section and the Natural Resources Section of the Office of the Attorney General, State of Colorado, 1975-1984. She has also worked in private practice in Denver, 1984-1985, as a trial attorney in the Denver Litigation Center, EEOC, 1973-1975, as a deputy public defender for the State of Colorado, 1971-1973, and in the New York City Legal Aid Society, 1969-1971. Judge Davidson received her law degree from the University of Pennsylvania School of Law in 1969. Judge Davidson believes it is important for judges to serve the community and has participated in a number of local, state, and national bar and civic association activities. Currently, she is the chair of the Supreme Court Standing Committee on Appellate Rules. Additionally, she is a long-standing member of the Supreme Court Standing Committee on Rules of Civil Procedure, serves on the Supreme Court Committee on Gender and Justice, and participates in the Colorado Judicial Department Leadership Development Institute and in the Judge William E. Doyle American Inn of Court. Judge Davidson is also an instructor in the Advanced Judges Orientation Program and is managing editor of the 1999 Colorado Appellate Handbook. The State Commission found Judge Davidson to be a serious, hard-working, and productive member of the Colorado Court of Appeals. She wrote more than 100 majority opinions in 1997, and has developed an efficient office system for tracking cases and producing opinions. She continues to find ways to improve her writing so that her opinions are clear and understandable to the lay public as well as the legal profession. Attorney questionnaires received by the State Commission rate Judge Davidson highly, especially with regard to her equal treatment of all parties. Of the responses received from attorneys, 88.5% recommended retention and 11.5% recommended do not retain.

    Retention Year: 1990 Recommendation: Retain Judicial Performance Commission’s recommendation: Should Be Retained. Judge Davidson graduated from Skidmore College with a bachelor of arts degree in government in 1966. She received her law degree from the University of Pennsylvania School of Law in 1969 and was admitted to the New York bar in 1969 and the Colorado bar in 1971. Her experience prior to her appointment included private law practice, 1984-85, and service as counsel for several government agencies in the following capacities: New York Legal Aid, attorney, 1969-71; Denver Public Defender’s Office, 1973-73; Equal Employment Opportunity Commission, Regional Litigation Center, counsel, 1973-75; Colorado Department of Law, assistant attorney general, 1975-84. Davidson was appointed as a county judge in August 1985 and served in that capacity until her appointment to the Colorado Court of Appeals in May 1988. Attorney and trial court judges noted that Davidson exhibits a high level of interest and devotion to her work and possesses a number of positive judicial qualities, including legal scholarship, decisiveness, and organizational ability, which are necessary for a member of the court. Comments from attorneys suggest she improve her patience in the courtroom. Davidson stressed she would work to correct that perception.

In addition to this introduction, the report is divided into four main sections: · Attorney Results & Comments: This section contains graphs displaying the average grade you received overall (the combined average from questions 2a through 2l) Following the graphs, are a series of tables showing the percentage distribution of responses to each question. Attorney respondents were also asked to comment about your performance. These comments have been transcribed, and in some instances redacted to eliminate respondent identifying information. Talmey-Drake Research was also provided with the list of Colorado judges and justices. Two surveys were conducted, one among attorneys who had opinions authored or co-authored by one of the six Court of Appeals judges facing a retention vote in 2006, and a second survey of all Colorado judges and justices. Questionnaire: Copies of the two questionnaires used are provided at the end of this report. Respondents were asked to use a grade of A, B, C, D, or F (Fail) to assess the judge’s performance in a number of different areas. These grades were then converted to a numerical value where A = 4, B = 3, C = 2, D = 1 and Fail = 0. Response: The response rate is calculated as the number of completed questionnaires divided by the number of eligible respondents who actually received a questionnaire. The following table shows the total number of questionnaires mailed, completed, non-responses & refusals, undeliverables and other responses. The table presents the overall response rate for each survey as well as the response rate for your surveys. Within each main section are three subsections: graphs displaying average grades for each section and question, the percentage distribution of grades, and respondent comments. Graphs: The graphs visually display the overall average numerical grades received for all grade questions, each section and each question compared to the combined averages for all the other Court of Appeals judges for which surveys in 2006 were conducted. Percentage Distribution of Grades: This section shows the percentage of each grade received on each question plus the bias, sentencing and retention questions. An average grade point for each graded question is computed and shown in the results section. A letter grade is also assigned to each grade point according to the following scale. A = 4.00 B = 3.00 to 3.33 C = 2.00 to 2.33 D = 1.00 to 1.33 A— = 3.68 to 3.99 B— = 2.67 to 2.99 C— = 1.67 to 1.99 D— = 0.67 to 0.99 B+ = 3.34 to 3.66 C+ = 2.34 to 2.66 D+ = 1.34 to 1.66 Fail = 0.00 to 0.67 This section also includes a comparative column of results showing the results for that question for all other Court of Appeals judges for which surveys were conducted in 2006. Comments: Each respondent was encouraged to comment on the judge’s performance. This section contains these comments—again divided between results from attorneys and judges. Sampling All sample surveys are subject to what is known as sampling error—the Error: extent to which the results of the sample survey may differ from what would be obtained if the entire population being surveyed had been interviewed. The size of the sampling error is almost entirely due to the number of people interviewed for the survey and the variance of responses. The table below shows the extent of sampling error (95%-confidence interval) for various sizes of random samples and sample percentage results.
