Please click on the link below and email our staff Contact Us The Eleventh Judicial District Commission on Judicial Performance unanimously recommends that Judge William G. Fox BE RETAINED. Judge Fox was appointed to the County Court bench in Fremont County in 1986 and currently hears criminal (including felony and misdemeanor), traffic, traffic infractions, domestic relations and civil cases. Surveys for evaluation of Judge Fox were completed by attorneys who have practiced in his court. Non-Attorney surveys were completed by defendants, plaintiffs, law enforcement, employees, jurors, and victims. The responses to the surveys rated Judge Fox highly overall. Attorney participants surveyed strongly recommended that Judge Fox be retained by a percentage well above the statewide average for other county court judges. Although non-attorney participants surveyed were less positive, non-attorneys recommended that Judge Fox be retained at the rate of 72%, just slightly below the statewide average for non-attorneys. Based upon information supplied to the Commission through surveys, public hearings, a personal interview with Judge Fox, and courtroom observations, the Commission feels that Judge Fox should be commended for his continuing legal education for himself, the legal community and the public, for his initiative in developing procedures to make justice more efficient and for his willingness to remedy the concerns reflected by non-attorneys concerning his ability to communicate. Judge Fox is aware of his ethical duties and works to avoid any appearance of impropriety. Judge Fox is active in community affairs as evidenced by his involvement in the DARE Program, by training Russian police, prosecutors and judges on domestic violence cases and restraining orders in the Cañon City/Valdai (Russia) Sister City Association, and by teaching the Judicial program for the Leadership Conference of the Cañon City Chamber of Commerce. Judge Fox respects his role as judge and is committed to being a member of the judiciary by showing initiative, as evidenced by the work he has done to establish County Court Directives governing procedures in his court which are available to all parties and attorneys; being the first judge in Colorado to provide Attorney Mediators for the Small Claims Courts; receiving one of three Colorado scholarships to attend the Scientific Evidence and Expert Testimony program at the National Judicial College in 2002; and developing procedures for handling inmate civil cases which have been copied by courts in other Colorado counties which have state prisons and inmate litigation.

Based upon information supplied to the commission through the questionnaires, public hearings and a personal interview with Judge Fox, the commission feels that Judge Fox has done an exceptional job in managing the Fremont County Court case load. Judge Fox is very efficient, and coordinates well with courthouse personnel. He established County Court Directives governing procedures in his court, which are available to all parties and attorneys. As indicated by his longevity on the County Court bench, he finds his job interesting, challenging and is comfortable in his work. He has a serious commitment to the judicial system as evidenced by his recent trip to Russia with a team educating persons in that country as to policies and laws on domestic violence in the United States. Judge Fox was recently appointed by the Chief Judge as the judicial representative on the Judge-Attorney Liaison Committee to enhance communications between the judiciary and the attorneys in the Fremont-Custer County Bar Association. Information reviewed by the commission indicates Judge Fox is fair, impartial and knowledgeable in the law and rules of evidence.

The responses to the questionnaires rated Judge Fox highly overall. Judge Fox is very efficient and coordinates well with courthouse personnel. He has an enormous case load in the Fremont County Court and has inadequate staff to assist him. However, he has exceptional control over the docket and treats parties appearing in front of his fairly and courteously. The commission received some information indicating that Judge Fox is occasionally impatient in court, but it is the position of the commission that some impatience is warranted and justified by the pressures attendant with a very busy docket and heavy case load. Judge Fox is committed to a high standard of judicial ethics and demonstrates a sense of justice in his rulings. Judge Fox encourages educational activity for his staff, speaks in the local schools, and has been an evidence instructor for the Judicial Department for the State of Colorado. Judge Fox actively seeks ways to improve the functioning and efficiency of the county court and continues to implement policies and procedures that make the county court more responsive to the needs of the persons who appear in front of Judge Fox.

    Retention Year: 1992 Recommendation: Retain Judge Fox has been the County Court Judge for Freemont County since his appointment to the bench July 1, 1986. He is a “90%” County Judge, which means that the caseload of the Freemont County Court is determined to require 90% of a full-time equivalent judge. He is permitted to practice law bud does not currently do so. Since his appointment to the bench he has completed the General Jurisdiction course for trial judges at the National Judicial College in Reno, Nevada. Judge Fox was admitted to the bar in 1977, having received his law degree from the University of Colorado that year. He was in private practice from 1978 until 1986, and served as Florence City Attorney from 1979 until 1986. While in private practice he served on the Ethics Committee of the Colorado Bar Association for one year. In presiding over Freemont County Court, Judge Fox hears cases of limited civil jurisdiction, and criminal cases involving primarily traffic, misdemeanor, and petty offenses. He occasionally is assigned to District Court cases by the chief judge of the 11th Judicial District. Judge Fox stood for retention in 1988 and was evaluated by a local Judicial Evaluation Committee under the auspices of the Colorado Judicial Institute. He was recommended for retention by the committee, and was retained as county court judge by the electorate in the November 1988 election. Judge Fox has initiated a number of changes in the Fremont County Court since 1986, in order to streamline the process and make the court more efficient in the face of increasing volume. He noted in his interview with the Judicial Performance Commission that when he was first appointed to the bench there was a six-month backlog of cases. Currently hearing dates are set approximately one month into the future. In his interview Judge Fox emphasized his desire to treat people fairly who come before him, and defined fairness as applying the law correctly. Of those polled, including attorneys, litigants, jurors, law enforcement personnel, staff persons and probation and social service workers, there was ninety to one hundred percent agreement that Judge Fox displays a sense of justice, treats all parties equally, gives clear oral and written decisions, displays appropriate demeanor, works diligently, is prompt in his rulings, and sentences fairly. Comments provided by those polled indicated that Judge Fox is viewed as a hard working judge with excellent knowledge of the law who runs his court efficiently and treat those who come before him fairly. The Commission also considered comments made during a public hearing. The 11th Judicial District Commission on Judicial Performance recommends that Judge William Gobin Fox be Retained.

The 2004 survey was conducted by Talmey-Drake Research & Strategy, Inc., who attempted to contact over 35,000 people who had been in these courtrooms in one capacity or another. Over 10,000 people responded—3,683 to the attorney survey and 6,330 to the non-attorney survey. This report contains the results of those who were in your courtroom and who responded to the survey. In addition to this introduction, the report is divided into four main sections: · Attorney Results & Comments: This section contains graphs displaying the average grade you received overall (the combined average from questions 1a through 5e as required by the recent rule changes) , each section and each question. Following the graphs, are a series of tables showing the percentage distribution of responses to each question. Attorney respondents were also asked to comment about your performance. These comments have been transcribed, and in some instances redacted to eliminate respondent identifying information. These names and addresses where then supplemented from the Colorado District Attorney’s database (Blackstone system) and the databases of jurors, court employees and sheriff’s security. The data was then combined and cleaned. Where there were more than 400 potential respondents, a random sample was drawn. Included in the data cleaning was the identification of potential respondents in the sample who had appeared in more than two judges’ courtrooms. Due to concerns about respondent fatigue, no more than two questionnaires were intended to be sent to any one respondent—though there were a few instances where one respondent did receive more than two questionnaires. Where a person had been in more than two judges’ courtrooms, the selection criteria for which judges he or she would be sent questionnaires was generally: first, for the judge in whose courtroom the potential respondent had been in most often, and two, the judge with the smallest sample of the judges in whose courtroom the potential respondent had been in. Survey: Starting in November 2004, each person in the sample database was mailed an initial questionnaire and an introductory letter with a postage-paid return envelope. Those who did not respond to the first questionnaire were then sent a sent a second questionnaire and letter, and in some cases reminder postcards. During this process, the sample was augmented for judges with a particularly low number of completed questionnaires. Questionnaire: The questionnaire used in the 2004 Judicial Performance Survey asked respondents to use a grade of A, B, C, D, or F (Fail) to assess the judge’s performance in five different areas. For attorney these areas were Case Management, Application and Knowledge of Law, Communications, Demeanor and Diligence, and for non-attorney respondents the five were Demeanor, Fairness, Communications, Diligence and Application of Law. These scores were then converted to a numerical value where A = 4, B = 3, C = 2, D = 1 and Fail = 0. Copies of the questionnaires are included at the end of this report. Response: The response rate is calculated as the number of completed questionnaires divided by the number of eligible respondents who actually received a questionnaire. The following table shows the total number of questionnaires mailed, completed, non-responses & refusals, undeliverables and other responses. An average grade point for each graded question is computed and shown in the results section. A letter grade is also assigned to each grade point according to the following scale. Sampling All sample surveys are subject to what is known as sampling error—the Error: extent to which the results of the sample survey may differ from what would be obtained if the entire population being surveyed had been interviewed. The size of the sampling error is almost entirely due to the number of people interviewed for the survey and the variance of responses. Averages such as grade points also have a 95% confidence interval, however it is not so easily displayed in a table as confidence intervals about a percentage.
